CONDITIONS OF USE OF FOURS CINEMA INC.

(Cinéma FourS)

Please read carefully the following terms of use (hereinafter the “Terms of Use“) of FOURS CINEMA INC. a company whose head office is located at 6 – 8445 Rue de Londres, in the city of Brossard (J4Y 0P1), province of Quebec in Canada (hereinafter “FourS Cinema“).

FourS Cinema operates this website (hereinafter the “Platform“) and the social media pages, account, network or any application contained therein designed and managed by FourS Cinema (hereinafter the “Social Media“).

By deciding to use the Platform and FourS Cinema’s services, the user, understood as the end user or the organization you represent or for which you work (hereinafter the “User” or “Users” or “you”) accepts all the Terms of Use indicated below which govern the content and use of the Platform, as well as the privacy policy appearing at the end of FourS Cinema’s Terms of Use.

These Terms of Use are legally binding on the User and FourS Cinema (hereinafter the “Parties“). The Parties are entitled to invoke the present Terms of Use and to take all useful and necessary measures to ensure that they are respected.

If the User does not accept these Terms of Use or, as the case may be, the Terms of Use as amended from time to time, the User must not, or must no longer, use the Platform.

Terms defined in these Terms of Use are used in FourS Cinema’s privacy policy and terms and conditions of sale, if any (the Terms of Use, privacy policy and terms and conditions of sale are hereinafter referred to as the “Legal Terms“). We recommend that you read them carefully too.

ACCESS AND USE OF THE PLATFORM

If you browse the Platform, this means that you have read, understood, and accepted the Terms of Use.

The Platform is accessible from any computer (computer, smartphone, tablet, etc.) and on any browser.

For optimal use, we recommend the use of the following browsers: Google Chrome, Internet Explorer, Mozilla Firefox.

THE SERVICE

The Platform is accessible at all times. The Platform may be temporarily unavailable due to updates or technical problems. FourS Cinema is not responsible for any interruptions in service or updates. FourS Cinema attempts to perform updates when traffic on the Platform is at its lowest.

FourS Cinema does not warrant that the Platform, or any part thereof, will operate on any particular computer hardware or peripherals. Furthermore, the Platform may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

FourS Cinema reserves the right to add, delete and modify all content, or any part of it, on the Platform, with the exception of the User’s own content. FourS Cinema cannot be held responsible for mistakes, typographical errors, and bugs. Each User created in the system is the owner of the content of his/her account. FourS Cinema does not delete anything unless a User requests it.

Each User of the Platform undertakes, without limitation, not to:

  1. Use the Platform in a manner that could damage, disable, overburden or impair the Platform;
  2. Disrupt the security of or otherwise abuse the Platform or any services, resources, systems, servers or networks connected to or linked to or accessible through the Platform or affiliated sites;
  3. Disrupt or interfere with the use or enjoyment of the Platform by other services or affiliated or linked sites;
  4. Upload, post or otherwise transmit on the Platform a virus or other harmful, disruptive or destructive computer file or program;
  5. Use a robot, spider or other automatic device or manual process to monitor or copy Platform pages or content;
  6. Transmit unsolicited e-mails, chain letters, spam or other types of mass e-mail through the Platform;
  7. Attempt to gain unauthorized access to the Platform or portions thereof to which access is restricted. In addition, the User agrees that he is solely responsible for all actions and communications undertaken or transmitted to or on his behalf and agrees to comply with all applicable laws with respect to their use of or activities on the Platform.

INTELLECTUAL PROPERTY

Unless otherwise indicated, all intellectual property rights (trademark, copyright, etc.) (hereinafter the “Intellectual Property“) related to the Platform are the exclusive property of FourS Cinema. You may not copy or use any of the materials, structure, menu, look and feel or characters that appear on the Platform without the express consent of FourS Cinema.

Certain names, words, titles, phrases, logos, icons, graphics, designs, domain names or other content contained on the Platform or Social Media may, among other things, be registered or unregistered trademarks or trade names (all of which are referred to in these Terms of Use as “Trademarks“). These Trademarks are protected by Canadian and foreign trademark laws and are, as the case may be, the exclusive property of FourS Cinema.

Without limiting the generality of the foregoing, Intellectual Property owned by FourS Cinema includes, but is not limited to, the following:

  • All logos, drawings, graphics, photos, videos, trademarks (registered or not), symbols, texts, expressions, words and all general content of the Platform or Social Media not already subject to intellectual property rights;
  • All software, APIs and materials made available by the Platform;
  • All databases made available by the Platform or the Social Media; and
  • All the content offered by the Platform, available for free download.

Unless otherwise indicated, all information provided on the Platform is the property of FourS Cinema and is protected by applicable laws. In addition, the information may not otherwise be copied, displayed, distributed, downloaded, unlicensed, modified, published, reproduced, reused, sold, transmitted, or used for derivative works, public or commercial purposes without the express written permission of FourS Cinema. The information is protected under the copyright and trademark laws of Canada and the countries that host the Platform or Social Media.

You may use the information exclusively for your personal use without modification, provided that you reference on all copies the respective copyright notices and trademark attributions. These Terms of Use grant you permission to view, display on your computer, download, and print the text and images, as well as the free tools, webinars, articles, videos, calendar of events, information guides, presented on the Platform, solely for non-commercial, personal and supporting purposes, provided that the content of the Platform is not modified in any way. This authorization belongs solely to you; it may not be assigned or transferred to any other person, nor may it be sublicensed.

Images and text, as well as free tools, webinars, articles, videos, calendar of events, information guides, contained on the Platform or Social Media that are downloaded, copied, saved, or printed are still subject to these Terms of Use. You must ensure that all copyright and trademark notices are retained. The content of the Platform or Social Media may be changed at any time without notice. For further information regarding permission to use, reproduce or republish any information presented on the Platform or Social Media, please contact us at info@fourscinema.com.

Nothing contained herein shall be construed as conferring any license or right upon the User under any copyright or trademark laws.

Any unauthorized downloading, retransmission, copying or modification of Intellectual Property or data contained on the Platform or Social Media may violate laws including those relating to trademarks or copyrights, and could subject the User to legal action.

EXTERNAL LINKS

It is possible that by using a hyperlink, the User leaves the Platform or Social Media to access external content (hereinafter the “External Websites“). FourS Cinema makes available to Users, in addition to its own content, links to External Websites solely for the User’s convenience and information. FourS Cinema has no control over the content of these External Websites and assumes no responsibility for their accuracy, precision, completeness, authenticity, timeliness, or suitability. All liability of FourS Cinema is excluded, in particular for direct or indirect damage or consequences arising from the use of the contents of these External Websites. FourS Cinema has no influence whatsoever on the content of linked external websites and accepts no liability for the content of external links, in particular for any changes made after the link was set. FourS Cinema does not demand that information be transmitted, nor does it select the recipients of the information transmitted or the information itself, nor does it modify it. In addition, FourS Cinema does not automatically make any short-term intermediate storage of these external links in accordance with the current method of creating and viewing links. Responsibility for the content of linked External Websites therefore rests exclusively with their operators.

In addition, FourS Cinema does not warrant or represent that such External Websites or their content will not violate any law, including any copyright, trademark or other third-party rights, or be free of viruses or other harmful components.

No guarantee is given as to the authenticity of the documents available on the Internet.

SOCIAL MEDIA

The following terms apply when you access a Social Media page.

General statement

By using the Social Media pages and submitting a comment, photo, video, or other material, you (and your parent/legal guardian if you are under the age of majority in the province or territory in which you reside) agree to be bound by and comply with FourS Cinema’s Legal Terms and the terms of use of third-party Social Media providers. You also consent to FourS Cinema copying, editing, publishing, translating, and distributing your comment, photo, video, or other material posted on a Social Media without compensation.

Social Media Terms of Use

Some of the comments and other materials posted on Social Media pages may not represent the views of FourS Cinema. Accordingly, you agree not to post or submit any information, postings, links, or other materials of any kind to the Social Media pages that fall into any of the categories described below with respect to FourS Cinema:

  • Any content that is defamatory, abusive, counterfeit, obscene, misleading or illegal;
  • Any content that otherwise violates the rights (including privacy rights) of others;
  • Any content enclosing advertising;
  • Promotional documents or any form of unwanted solicitation;
  • Any content whose origin or source is falsified;
  • Any financial or personal information about you or any other person; and
  • Any information that FourS Cinema deems to be in violation of the Terms of Use.

Any information, message, link, or item that FourS Cinema deems to fall into any of the above categories will be deleted immediately, without liability to FourS Cinema.

Furthermore, FourS Cinema does not assume responsibility for filtering messages posted on Social Media.

FourS Cinema disclaims all liability with respect to entities that own or operate Social Media, including for any direct or indirect loss or damage arising from any action or decision made by you or any other person in connection with the use of Social Media websites.

DISCLAIMER, EXCLUSION OF WARRANTY AND INDEMNIFICATION

FourS Cinema does not guarantee the accuracy, completeness, quality, suitability, or content of the information on its Platform. This information is provided “as is”, without warranty or condition of any kind, either express or implied, including, but not limited to, implied conditions and warranties of merchantability and fitness for a particular purpose, except in jurisdictions that do not allow the exclusion of implied warranties.

FourS Cinema is not responsible for the content posted on the Platform by Users and for any damage that may result therefrom. Each User is responsible for the content he/she exchanges on the Platform and may not use the Platform for purposes contrary to the laws applicable in Quebec and Canada.

When the User is a consumer within the meaning of the Consumer Protection Act (CQLR, c. P-40.1), the latter does not allow the exclusion of warranties and the non-responsibility of FourS Cinema for certain damages. In this case, the User has additional rights and is not subject to some of the limitations mentioned below.

Except where the Consumer Protection Act (CQLR, c. P-40.1) is applicable, FourS Cinema shall not be liable for any direct, indirect, special, incidental or consequential damages, or any other damages whatsoever, including but not limited to loss of revenue, profits or anticipated economic benefits, arising out of the use of or inability to use the Platform, the information, documents and software contained therein, and the contents thereof, even if FourS Cinema has been advised of the possibility of such damages or even if such damages can be reasonably foreseen.

As a User, you will indemnify FourS Cinema, and, where applicable, its directors, officers, shareholders, partners, employees, agents, consultants and other FourS Cinema stakeholders, and hold them harmless from and against any and all claims, liabilities, losses and expenses (including legal fees) attributable to your use of the Platform and/or breach of these Terms of Use, whether such breach is by you or any third party user of your account.

You may not use or export the information or any copy or adaptation of the information in contravention of any applicable laws or regulations.

MODIFICATION OF THESE CONDITIONS

FourS Cinema occasionally updates these Terms of Use. Continued use of the Platform constitutes the User’s agreement to these Terms of Use and any updates.

However, where the Consumer Protection Act (CQLR, c. P-40.1) applies, FourS Cinema will notify current Users of the Platform thirty (30) days prior to the effective date of the modification. If the User refuses these modifications and wishes to no longer use the Platform, he/she will have thirty (30) days following the effective date of the modifications to send a notice to FourS Cinema. If the User objects to any changes made to these Terms of Use, the User must cease all use of the Platform.

INTERPRETATION

The headings of the preceding sections are inserted for reference purposes only and shall not affect the construction or interpretation of the provisions of these Terms of Use.

Whenever the context requires, any word written in the singular also includes the plural and vice versa; any word written in the masculine also includes the feminine and vice versa.

CODE OF CONDUCT OF THE MOVIE THEATRE

The code of conduct must be followed by every guest regardless of age while in the movie theatre premises and while watching the movie. For more details, every guest must read the code of conduct of the theatre and must follow. Violations to the code of conduct mentioned by the theatre will not be acceptable.

PRIVACY POLICY OF FOURS CINEMA INC.

INTRODUCTION

In the face of new challenges and dangers relating to the preservation of the security of personal information arising from online business, it is necessary to pay particular attention to the protection of privacy. That’s why FourS Cinema takes the privacy of your personal information seriously and is committed to respecting the confidentiality of the information it collects.

FourS Cinema is committed to respecting, in accordance with this privacy policy (hereinafter the “Policy“) and applicable laws in force in Canada and Quebec, the obligations concerning the collection and processing of your personal and confidential information, obtained in the course of operating its business, so that everyone can benefit from the respect of their privacy.

In doing so, FourS Cinema wishes to ensure the accuracy, security, and confidentiality of your personal information, and not to collect, use or disclose your personal information other than in accordance with this Policy and such applicable laws.

The Policy describes the information that FourS Cinema may collect from its Users in the course of its activities.

The Policy also describes, among other things, how FourS Cinema collects, processes, and stores your information, the purposes for which it is collected, how it is used and the circumstances in which it may be transmitted to third parties. The Policy explains your rights regarding the collection, use and disclosure of your personal information.

SCOPE OF THE POLICY

We collect your personal information as part of our mission to:

  • Offer a cinema experience with an extensive selection of films from different cultures, particularly from India;
  • Offer live performances and events of local talent featuring singers, dancers, and bands; and
  • Different stationery and accessories products including but not limited to Caps being headwear, hats, shirts, coats, dresses, jackets, sweaters, hoodies, polos, mugs, key-chains etc.

By browsing the Platform or subscribing to our email publications, the User agrees to the terms and conditions of this Policy. You agree that your personal information collected when filling in any online form, particularly in order to make contact, upload content to the Platform, or render other product-related services, will be transmitted to the relevant and authorized FourS Cinema personnel. The latter will only communicate to third parties whose participation is strictly necessary for the delivery of the product and/or the maintenance of our commercial relationship with you, as the case may be, the information necessary for these purposes (the aforementioned third parties may hereinafter be collectively referred to as the “Third-Party Providers“).

By providing FourS Cinema with your personal information, you authorize FourS Cinema to use and disclose your personal information to Third-Party Providers, as the case may be, in connection with the delivery of product, the management of our contractual relationship, our business relationship with you, and in accordance with this Policy and as authorized or required by law, as well as implicitly, if indicated by the circumstances.

In addition, FourS Cinema will seek your consent before using your personal information for purposes other than those covered by your initial consent under the Policy.

Finally, you may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice. Please be aware, however, that without your consent, FourS Cinema may not be able to provide or continue to provide you with certain product or information that may be useful to you.

If you provide FourS Cinema or its Third-Party Providers with personal information about another individual or entity, you agree that you have the necessary authorization to do so and/or that you have obtained all necessary consents from that third party to allow us to collect, use and disclose their personal information for the purposes set out in this Policy.

COLLECTION OF PERSONAL INFORMATION

Personal information is information that is specifically associated with a natural person and that can be used to identify that person, either on its own or in combination with other information that FourS Cinema may have access to. Information that has been rendered anonymous or arranged so that it can no longer be used to identify a particular individual does not constitute personal information. For example, an individual’s office mailing address is not personal information in and of itself, except when it is mentioned in conjunction with other information about the individual, or when its mere mention would reveal personal information about the individual.

FourS Cinema may obtain personal information from the User by saving personal information on the Platform or, where applicable, by otherwise transmitting personal information, including by creating a User account and choosing a password, by logging in as a registered User to the Platform, by conducting a product search, requesting a service, providing account information, communicating with us by telephone, e-mail or otherwise, or by filling out a form to participate in a contest, inventory request, promotion or survey. By completing such a form, you authorize us to collect your personal information.

We collect the following information from the User upon registration:

  • Surname and first name;
  • Gender;
  • Telephone number;
  • Personal address;
  • Email address; and
  • Bank information, only when needed.

User information is also collected through the interaction that may be established between the User and the Platform and may be used for the following purposes:

  • Providing services to the User;
  • Managing customer accounts;
  • Managing customer relations and business relationships; and
  • Shipping products to the customer.

The User’s personal information will not be retained beyond the purposes for which it was collected. FourS Cinema respects the retention period established by this Policy, which complies with the Privacy Act (RSC, 1985, c. P-21) and An Act to modernize legislative provisions as regards the protection of personal information (SQ 2021, c 25). Data deletion occurs when the User deletes his/her account. The User will then have thirty (30) days to recover his/her data, failing which FourS Cinema will permanently delete it.

FourS Cinema may also compile lists of your names and mailing addresses for philanthropic, anonymized statistical or market research purposes. If you do not wish your name and mailing address to be used for these purposes, please contact us at info@fourscinema.com.

The deletion of personal information takes place when the User submits a written request to the aforementioned address. FourS Cinema reserves the right to refuse a User’s request if the User continues to use FourS Cinema’s Platform or services in any way that complies with the retention period established by this Policy, which complies with the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1). Accordingly, and unless otherwise provided for by the regulatory framework, the deletion of data will be effective thirty (30) days after the processing of the request for deletion of personal information by the privacy officer.

The Platform is designed for use by adults only as understood in the province of Quebec. FourS Cinema does not knowingly collect personal information from persons under the age of eighteen (18).

For more information on the protection of your personal information and your related rights, you may contact the Office of the Privacy Commissioner of Canada or the Commission d’accès à l’information du Québec.

FORMS AND INTERACTIONS

FourS Cinema collects your personal information in accordance with legal requirements. Wherever possible and appropriate, we collect your personal information directly from you or from the persons you have chosen to provide us with your personal information.

The User’s personal information may be collected by means of forms, namely:

  • Platform registration form;
  • Order form; and
  • Contact form.

Your basic personal information, such as your e-mail address, last name, first name, and telephone number, may also be collected on our Platform, notably by e-mail.

ADVERTISING INFORMATION

FourS Cinema will only communicate with you if you want it to.

If the User has not subscribed to our newsletter, does not have a commercial relationship with FourS Cinema or has never purchased one of our products, the User will not receive any e-mail from FourS Cinema without prior consent.

If you prefer not to receive promotional information from us or if you do not want us to use your personal information to enhance your experience as a User, please let us know by contacting us at the contact indicated in the “Your Rights” section below.

Please remember to include your full name and the e-mail address you used when you registered or made a purchase from us. There may be a delay in processing an e-mail or postal mail request and you may continue to receive communications from FourS Cinema in the interim.

ANTI-SPAM LEGISLATION

FourS Cinema complies with the requirements of the Canadian Anti-Spam Act (CASL) (S.C. 2010, c. 23).

The User understands that he/she may expressly or tacitly consent to receive messages from FourS Cinema.

Express consent is consent requested from the User, which must be stated in clear and simple terms, and must include the purposes for which consent is sought, the prescribed information identifying the person seeking consent and, if it is sought on behalf of another person, the prescribed information identifying that person; and any other information specified by regulations made under the Canadian Anti-Spam Act (CASL) (S.C. 2010, c. 23).

The User understands that he/she is giving tacit consent in the case of ongoing business relationships or ongoing private relationships; when the User publishes his/her e-mail address without mentioning that he/she does not wish to receive unsolicited commercial electronic messages; or when the message is sent in the other circumstances provided for by the regulations made under this law.

  • For the purposes of this Policy, a current business relationship refers to an established business relationship between two persons such as a purchase or lease during the two years preceding the date the message is sent; an investment or game offered; the barter of a thing; any contract in effect or expired during that period; or a request during the six months preceding the date the message is sent.
  • For the purposes of this Policy, a current private relationship is defined as a relationship between two persons other than a business relationship, such as a gift or donation, volunteer work; and a membership, as defined by regulations; all within the two preceding the date the message is sent.

PROTECTION AGAINST FRAUD AND THEFT OF YOUR PERSONAL INFORMATION

FourS Cinema undertakes at all times to comply with the laws and regulations applicable to its business and to take all useful and necessary measures to detect and prevent negligence, fraud and theft of your personal information. However, although FourS Cinema takes precautions, FourS Cinema cannot guarantee that no case of fraud or theft of your personal information may occur.

FourS Cinema maintains an up-to-date privacy incident log and will contact any User whose personal information is the subject of such an incident and presents a risk of serious harm.

THIRD-PARTY ADVERTISING DISPLAYED ON OUR PLATFORM

You may find third-party advertising displayed on our Platform. We do not allow third parties to collect your personal information on our Platform without your consent.

FourS Cinema prohibits and is not responsible for the resale or use by third parties of opt-ins obtained through the Platform. If you have agreed to share your contact information with partner organizations, we will share it with them.

We do not sell or rent your personal information without your consent.

THIRD-PARTY SERVICES

FourS Cinema may use, as part of its service and / or management of its business and its Platform, third party services. In no event shall FourS Cinema be liable for any damages arising from such third-party services. To find out about the conditions of use of these services, we invite the User to consult their respective websites.

INTERNATIONAL COMMUNICATIONS

In certain situations, it is possible that the User’s data may transit through servers outside Canada, notably in the United States.

FourS Cinema may also share your personal information with third parties located outside of Quebec, in accordance with the terms of this Policy.

FourS Cinema will not share your personal information with third parties located in jurisdictions that do not offer a similar level of privacy protection as Quebec.

SHARING PERSONAL INFORMATION

FourS Cinema undertakes not to commercialize the personal information collected without the express consent of the User. The only situation in which personal information may be sold is in the event of a partial or total transfer of the business to a third party. In such a case, the information transferred as an asset of FourS Cinema will be subject to the same guarantees as those in this Policy.

Unless otherwise specified in this Policy, personal information provided by the User will not be transferred to third parties without the User’s consent. However, we may share such information with Third-Party Providers in order to deliver the service or to maintain our relationship with you. In such cases, you hereby expressly consent to such sharing.

FourS Cinema may also publicly republish or re-share personally identifiable information when you post FourS Cinema-related content on Social Media. In addition, by clicking on an external link located on the Platform, you may access External Websites that have their own privacy policies. You are therefore advised to consult them, as you will be subject to them.

If the User does not wish his or her personal information to be communicated to third parties or partners, he or she may object at any time, as mentioned in the following “Your Rights” section.

FourS Cinema may, in the following cases, exceptionally disclose the User’s personal information without the User’s consent:

  • In the event of a legal obligation, in particular where a court order requires FourS Cinema to disclose the User’s personal information.
  • When it is impossible to obtain the User’s consent and privacy laws allow FourS Cinema to disclose this personal information. This is particularly the case when the protection of the public interest so requires.

YOUR RIGHTS

GENERAL RIGHTS
We are committed to offering the User the following rights with regards to his or her personal information:

  • The right of access;
  • The right to rectification;
  • The right to erasure;
  • The right to restrict processing;
  • The right to object to processing;
  • The right to data portability;
  • The right to lodge a complaint with a supervisory authority; and
  • The right to withdraw consent.

In certain circumstances, you have the right to have your personal information deleted without undue delay. These circumstances are as follows:

  • Personal information is no longer required for the purposes for which it was collected or otherwise processed;
  • You withdraw your consent to processing based on consent;
  • You object to the processing under certain rules of applicable data protection legislation;
  • Processing is carried out for direct marketing purposes; and
  • The personal information has been processed unlawfully.

However, there are exclusions to the right to erasure. General exclusions include where processing is necessary:

  • For the exercise of the right to freedom of expression and information;
  • To comply with a legal obligation; or
  • To establish, exercise or defend legal claims.

Your request relating to any of the rights mentioned in this section, or in the following section, must be made in writing and sent in accordance with the procedure set out in this section and in the “Privacy Officer” section.

The deletion of personal information takes place upon written request to the Privacy Officer. FourS Cinema reserves the right to refuse a User’s request if the User continues to use FourS Cinema’s services in any way.

FourS Cinema respects the retention period established by this policy, which is in accordance with the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1). Accordingly, and unless otherwise provided for by the regulatory framework, the deletion of data will be effective thirty (30) days after the processing of the request for deletion of personal information by the Privacy Officer.

ACCESS TO YOUR PERSONAL INFORMATION

It is important that the personal information we hold about you is accurate and up to date. Please keep us informed of any changes to your personal information. The Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1) gives you the right to request access to and correction of the personal information we hold about you.
Other than as set forth in this Policy, your personal information collected by FourS Cinema hereunder will be accessible only by authorized and appropriate employees as defined by FourS Cinema.

FourS Cinema, subject to certain exceptions, may inform you of your personal information, how it is used and whether it has been shared with Third-Party Providers. You will also have access to this information for any modification or deletion.

Your request to consult, verify, correct or withdraw your consent to the use of your personal information, or to request access to, correction or deletion of any personal information you have provided to us, must be made in writing and sent in accordance with the procedure set out in this section and in the “Privacy Officer” section below. Please be sure to include your full name and the e-mail address you used when you registered. There may be a delay in processing an e-mail or postal mail request and you may continue to receive communications from FourS Cinema in the interim.

FourS Cinema will acknowledge your request in writing and may ask you to confirm your identity before providing you with this information. In principle, access to this information will be provided free of charge, but if you request a copy or transmission of your information, we may charge a reasonable fee. FourS Cinema will inform you of the amount in advance and give you the opportunity to withdraw your request. FourS Cinema will provide you with access to your information within thirty (30) days of receipt of your request or will provide you with written notice that additional time is required to fulfill your request.

In some cases, we may not be able to provide you with access to all or part of your information. If we are unable to do so, or if the law does not permit us to do so, we will provide you with an explanation and indicate what other measures are available to you.

WITHDRAWING YOUR CONSENT

Once you have given your consent to the collection, use and transfer of your personal information, you may have the legal right to withdraw your consent in certain circumstances. If you wish to withdraw your consent, please contact us at info@fourscinema.com. Please note that if you withdraw your consent, we may not be able to provide you with a particular product or service. FourS Cinema will explain the impact at that time to assist you in your decision.

SAFETY

The personal information that FourS Cinema collects is stored in a secure environment. FourS Cinema has adopted appropriate measures to preserve the confidentiality of personal information and to protect it against loss or theft, as well as unauthorized access, disclosure, copying, use or modification, taking into account, among other things, the sensitivity of the information and the purposes for which it is to be used. In addition, FourS Cinema requires that each employee, agent, or representative of FourS Cinema abide by this Policy.

To ensure the security of the User’s personal information, FourS Cinema uses, among others, the following measures:

  • SSL (Secure Sockets Layers) protocol;
  • Protected access to servers and computers;
  • Secured access to its premises;
  • Firewall;
  • Privacy policies; and
  • Procedures for the protection of personal information.

FourS Cinema is committed to maintaining a high level of security by integrating the latest technological innovations to ensure the confidentiality of the User’s transactions in order to protect the User’s personal data from unauthorized access, use or disclosure. FourS Cinema is committed to maintaining a confidentiality incident log.

However, as no mechanism offers maximum security, there is always a degree of risk involved when using the Internet to transmit personal information. If a password is used to protect the User’s account and personal information, it is the User’s responsibility to ensure that it remains confidential.

In the event of a privacy incident involving a User’s personal information held by FourS Cinema, FourS Cinema will notify the affected User and the Commission d’accès à l’information du Québec of any privacy incident presenting a risk of serious harm.

FRENCH AND ENGLISH

In the event of any problem of definition or interpretation between the French and English versions of these Legal Terms, the French version shall prevail.

APPLICABLE LAW AND COMPETENT COURTS

The Platform and its content are managed by FourS Cinema from its offices located in the province of Quebec, Canada. The Platform, the Social Media and their content, their Legal Terms and the User’s use thereof are all governed by the laws of Quebec and Canada applicable therein, without giving effect to any principles of conflict of laws.

You agree that all questions and disputes concerning the Platform and Social Media and the use thereof shall first be brought before a mediator and, in the absence of a compromise, decided by the courts of Montreal.

Notwithstanding any attribution of jurisdiction and applicable law, where the User is a consumer within the meaning of the Quebec Consumer Protection Act (CQLR, c. P-40.1), then any dispute relating to this Policy shall be governed by the laws of the Province of Quebec and shall necessarily be brought before a court of competent jurisdiction pursuant to the rules of the Code of Civil Procedure.

INTERPRETATION

This Policy is governed by the laws of Quebec and Canada applicable therein, including the federal Privacy Act (RSC, 1985, c. P-21) and An Act to modernize legislative provisions as regards the protection of personal information, (SQ 2021, c 25). These laws apply without giving effect to any principles of conflict of laws.

Whenever the context requires, any word written in the singular also includes the plural and vice versa; any word written in the masculine also includes the feminine and vice versa.

DIVISIBILITY

Each provision of this Policy forms a distinct whole and any decision by a court to the effect that one of the provisions of this Policy is null or unenforceable in no way affects the validity or enforceability of the other provisions of this Policy.

MODIFICATION OF THIS POLICY

We will occasionally update this Policy. Continued use of the Platform constitutes the User’s agreement to this Privacy Policy and any updates.

However, where the Consumer Protection Act (CQLR, c. P-40.1) applies, FourS Cinema will notify the current Users of the Platform thirty (30) days prior to the entry into force of the modification. This notification will be made by sending an e-mail, informing the User of the possibility to consult the details of the modifications on FourS Cinema’s website. If the User refuses these modifications and wishes to terminate the relationship with FourS Cinema, he/she will have at the latest thirty (30) days following the entry into force of the modifications to send a notice to FourS Cinema and terminate, without charge or penalty, their obligations to FourS Cinema, and must cease all use of the Platform.
